The website is protected by copyright. Any copy, adaptation, modification, translation, arrangement, communication to the public, location or any other exploitation of the site requires written permission from The Plastic Centre.

Trademarks and Tradenames

All logos and signs belonging to The Plastic Centre are legally protected. Unauthorized use is prohibited without written consent.

Liability for Content

Information is provided "as is" without warranties. The company assumes no responsibility for damages from website access or use. Third-party links are at the user's own risk.

Definitions
  • The buyer: Person or company accepting a quotation or placing an order
  • The seller: The Plastic Centre
  • Delivery Date: Estimated delivery time
  • Goods: The price excluding carriage, packing, insurance and VAT
  • Special Orders: Non-stock items manufactured upon request
Conditions Applicable

These terms prevail over buyer conditions unless otherwise agreed in writing. Quotations remain valid for 7 days maximum and are not binding. Placing an order constitutes an offer; a contract forms upon seller's written acceptance.

Delivery Date

Specified delivery dates are approximate only. If buyers refuse delivery, The Plastic Centre may store goods at the buyer's risk and cost, with disposal rights after 3 months.

Price

All quotations exclude value added tax. Prices remain valid for 7 days; new quotations required thereafter.

Risk

Goods become the buyer's risk upon delivery or collection.

Delivery by Instalments

Each instalment constitutes a separate contract. Non-delivery of one instalment does not affect the remaining contract or allow cancellation.

Non-Delivery

Non-delivery must be reported within 3 days of receiving dispatch notification.

Time for Payment

Payment is due when the order is placed and accepted. Cheque payments require cleared funds.

Property in the Goods

Risk

Risk transfers when goods are available for delivery at the stated point.

Title

The seller retains ownership until receiving payment in full (in cash or cleared funds) for both goods and other sums owed.

Storage of Goods

Until ownership transfers, buyers must hold goods separately, identifiable as the seller's property, and fully insured at market value.

Recovery of the Goods

The seller reserves the right to repossess goods and may enter premises during business hours for this purpose.

Recovery of Proceeds and Sale

Resale is permitted at full market value in ordinary business operations. Proceeds representing amounts owed must be held separately in fiduciary capacity.

Termination of Buyer's Rights

Possession rights terminate if the buyer fails to pay, becomes bankrupt, faces winding-up petitions, has unsatisfied judgements, becomes insolvent, or has legal action taken against assets.

Seller's Rights

Seller's rights under this clause remain effective even after contract termination.

General Provisions

Invalid provisions do not affect remaining terms. Neither party is liable for failures beyond reasonable control except payment obligations. Failure to exercise rights does not waive future enforcement.

Extension of Contract Period

Force majeure events including strikes, natural disasters, transport disruption, and government actions permit reasonable time extensions for performance.

Defects

The seller has no liability in relation to any consequential loss or damage except where defects cause death, injury, or property damage. Buyers must inspect goods and confirm satisfactory quality.

Defects must be reported within 3 days; liability is limited to replacement or refund only. Defective goods must be returned within 3 days at buyer's risk and expense.

A 25% restocking charge applies to returned goods unless defective. Special orders cannot be returned or refunded.

Fitness for Purpose

For non-standard purposes, buyers must notify the seller in writing before purchase. Goods comply with applicable British standards but may be modified to meet safety or statutory requirements.

Accepted orders cannot be cancelled except with written seller agreement and buyer indemnification of full costs.

Intellectual Property Rights

Buyers must indemnify the seller against third-party infringement claims arising from orders executed per buyer specifications.

Description of Materials

All specifications including dimensions are approximate; the company reserves alteration rights without notice.

Insolvency

The seller may immediately terminate if the buyer faces creditor meetings, voluntary arrangements, inability to pay debts, receivership appointments, or winding-up petitions.

Pallets

Pallet costs may be added to palletised deliveries. Pallets returned in original condition receive credit at the original price.

Notices

Written notices sent by first-class post are deemed received 48 hours after posting.

Third Party Rights

These conditions confer no rights on third parties except as expressly stated.

Jurisdiction and Choice of Law

All orders and disputes are governed by English law and subject exclusively to English court jurisdiction.
